Supervisor Walter called the meeting to order at 7:30 p.m. A quorum was present.

6.1 Request to Approve Minutes of the Regular Meeting held on June 10, 2003.

Motion by Treasurer Skrobola, supported by Trustee Brostrom, to approve the minutes of the regular meeting held on June 10, 2003, as corrected.

Trustee Brostrom handed some written punctuation corrections to the recording secretary. He also said on page 4, 3rd paragraph from the top, in the 2nd line the words “which”and “a”should be removed. He said on page 5, 6th paragraph, in the 2nd line the word “form”should be changed to “from”. He also suggested the word “State” should not be capitalized since the word “township”is not capitalized in the minutes. He said on page 7, in the 8th line from the bottom the word “with”should be removed. He said on page 8, 1st paragraph, in the 2nd line the word “so”should be removed and on the same page, 5th paragraph, in the 3rd line the word “what”should be removed. He said on page 13, 3rd paragraph, under item 14.1, it should read “…on a property or on a home…

Trustee Marine said on page 16, under item 15.2, his name should be changed to read “Jeffrey” not “Jeff”.

8.1 Adoption of 2003 Pittsfield Township and Road Commission Agreement.

Motion by Treasurer Skrobola, supported by Trustee Burhop, to adopt the 2003 Pittsfield Township and Washtenaw County Road Commission agreement.

Treasurer Skrobola said this had taken some time to prepare because a number of items had to be worked out with the new staff at the Washtenaw County Road Commission. He said he thought this was a successful package for 2003.

9.3 Motion to Adopt the Resolution to Set an Administrative Fee of $1,000.00, to set up an Industrial Facilities Exemption District and Process the Application.

Motion by Treasurer Skrobola, supported by Clerk Lirones, to adopt the resolution to set an administrative fee of $1,000.00, to set up an Industrial Facilities exemption district and process the application. (See attachment #1).

Trustee Marine asked how the amount of the fee was established.

Clerk Lirones said she contacted the Michigan Department of Treasury and spoke with Debbie Abbruzzese, who is very experienced in tax abatements. She said Ms. Abbruzzese explained the work involved in creation of the district and processing the application for exemption, which would involve time on the part of the township attorney, assessor, and other departments, as well as expenses for publication and mailing for public hearings. She said she asked Ms. Abbruzzese if there was a standard amount that most communities have settled on as the appropriate amount; Ms. Abbruzzese replied the fee could be anywhere from $500.00 to $1,000.00, and that the township’s expenses could easily amount to $1,000.00.

9.4Request to Approve Resolution to Hire Carl Walker as Document Systems Intern-Clerk’s Office, up to 20 hours per week, at $10.50 per hour, effective June 25, 2003.

Motion by Treasurer Skrobola, supported by Clerk Lirones, to approve the resolution to hire Carl Walker as document systems intern-Clerk’s Office, up to 20 hours per week, at $10.50 per hour, effective June 25, 2003.

WHEREAS, the Pittsfield Charter Township Board of Trustees authorizes the hiring of Mr. Carl Walker, for the position of Document Systems Intern.

AND, WHEREAS, Mr. Carl Walker would serve in the position of Document Systems Intern, effective June 25, 2003. for up to 20 hours per week, at a pay rate of $10.50 per hour.

NOW, THEREFORE, BE IT RESOLVED THAT, the Pittsfield Charter Township Board of Trustees authorizes the hiring of Mr. Carl Walker, to serve as the Township Clerk’s Office Document Systems Intern, effective June 25, 2003, at a pay rate of $10.50 per hour, for up to 20 hours per week.

Motion by Trustee Conner, supported by Trustee Brostrom, to purchase TB-SARS personal protective equipment for the Fire Department, with annual TB testing, and purchase of face masks through Bio-Care at a cost of $2,650.00 and fanny packs through EMP Products at a cost of $1,095.00, charged to account #336-777 Fire Equipment Supplies.

Trustee Marine said while the Fire Department definitely needs this type of protection from TB, he questions its usefulness against SARS. He said SARS and TB are two very different things, because one is a virus and one is a bacterium. He said he spoke with Acting Fire Marshal Nicholai, who in turn called the county, and the county indicated that this equipment was still recommended.

Supervisor Walter said it has not been proven that the virus can’t get through the face masks, but it is clear TB does get filtered out.

Trustee Marine said he wished to make the point that the Fire Department does need this for TB, but if the Fire Department came back a year from now and requested something more to help fight SARS, he would not be surprised. He said he just wanted to mention this information to the Board.

12.0 Items from the Office of Municipal Services/Planning and Zoning

12.1Request to Approve, from the Natural Resources Commission, the Huron River Watershed Council’s Proposal to Develop a Template, Public Education Plan and a Template, Public Involvement Plan, to comply with two of the mandatory minimum control measures required by the Phase II Storm Water General Permit Regulations. The cost will be $2,400.00 and charged to account #286.818-Contracted Services, and if approved, to Authorize the Pittsfield Township Supervisor to Sign Contract.

Motion by Treasurer Skrobola, supported Trustee Conner, to approve, from the Natural Resources Commission, the Huron River Watershed Council’s proposal to develop a template, Public Education Plan and a template, Public Involvement Plan, to comply with two of the mandatory minimum control measures required by the Phase II Storm Water general permit regulations, at a cost of $2,400.00, charged to account #286.818-Contracted Services, and to authorize the Pittsfield Township Supervisor to sign the contract.

Trustee Conner said the Huron River Watershed Council gave a thorough presentation to the Natural Resources Commission explaining the proposal in detail.

Clerk Lirones said this is something the township needs to do as part of the Phase II requirements.

12.2 Request Approval to Purchase Traffic Safety Construction Signage and Truck Lighting Devices. The Required Signs from Poco Sales at a cost of $4,873.95 and the Truck Mounted Light Bars from Automotive Service Co. at a cost of $1,503.50.

Motion by Trustee Conner, supported by Trustee Brostrom, to approve purchase of traffic safety construction signage and truck lighting devices, the required signs to be purchased from Poco Sales at a cost of $4,873.95 and the truck mounted light bars from Automotive Service Co. at a cost of $1,503.50.

WHEREAS, The use of proper traffic regulating devices is a requirement of the Washtenaw County Road Commission when working within its right-of-ways,
and

WHEREAS, The Utilities Department has researched its needs and identified the signs and traffic control devices necessary to operate in a safe manner in the road right-of ways, and

WHEREAS, The Utilities Department has requested and received quotes from three suppliers for the traffic control devices and identified a suitable supplier for the truck mounted lighting.

NOW THEREFORE BE IT RESOLVED, that The Pittsfield Charter Township Utilities Department be authorized to purchase the required signs from Poco Sales Inc. being the low bidder for a total cost of $4,873.95 and the truck mounted light bars from Automotive Service Co. for a total of $1,503.50.

Trustee Conner said the resolution does not state the account this is coming from.

Clerk Lirones said it was not necessary to add the account number to the minutes, since the number was only for informational purposes. She said it would be assigned a number when the bill is paid.

Supervisor Walter said he should be called during office hours for omissions such as this in order to get the necessary information for the Board meeting.

Trustee Marine referred to the memo from Interim Utilities Director Phil Maly which stated, “We prefer not to get three bids for this equipment….” He questioned whether they preferred not to get three bids or were unable to find three bids.

Supervisor Walter said that may be, or they may have had to go far and wide to find another supplier which may have been more effort than it was worth. He said again that these are the kinds of questions that need to be addressed during office hours.

Trustee Marine said it should be made clear that they should be getting three bids. He said saying “they prefer not to” is not a good reason, adding that by saying they can’t get three bids would be more reasonable.

Supervisor Walter said he would mention that to Interim Utilities Director Maly.

12.3 Resolution for Approval, RZ 02-08 Cody Properties [Second Reading].

Motion by Clerk Lirones, supported by Treasurer Skrobola, to adopt the resolution of approval for RZ 02-08 Cody Properties [Second Reading].

Clerk Lirones said the last paragraph of the resolution states “… the Pittsfield Township Board of Trustees approves the first reading…”. She said that should be changed to “…the second reading…” She said she thought there should also be a reference to when the first reading occurred in the third “WHEREAS”in both this resolution and the resolution regarding Park Place For Business.

Supervisor asked the Board if there was any objection to the proposed change in the language of the resolutions.

There were no objections, and Supervisor Walter declared the resolutions were therefore amended as described.

WHEREAS, The Pittsfield Township Planning Commission held a public hearing on the petition on June 5, 2003; and

WHEREAS, The Pittsfield Township Planning Commission considered comments presented or submitted by the public; and

WHEREAS, the Planning Commission recommended to the Pittsfield Township Board of Trustees that the request to rezone the property in RZ #02-08 from Agricultural (AG) and general Industrial (I-2) to Research and Development (R-D) be approved, and the Board approved the rezoning for first reading on June 10, 2003; and

WHEREAS, The Washtenaw County Metropolitan Planning Commission has waived its right to review Township rezoning amendments,

NOW THEREFORE BE IT RESOLVED That the Pittsfield Township Board of Trustees approves the second reading of the request to rezone the property in RZ #02-08 from AG and I-2 to R-D.

Motion by Trustee Brostrom, supported by Trustee Burhop, to adopt the resolution of approval for RZ 03-03 Park Place for Business major change [Second Reading].

WHEREAS, the Pittsfield Township Planning Commission held a public hearing on the petition June 5, 2003; and

WHEREAS, the Planning Commission considered comments presented or submitted by the public and made findings on the matter; and

WHEREAS, the Planning Commission recommended to the Pittsfield Township Board of Trustees that the request to add libraries to the approved use list for the Park Place for Business PUD District be approved and that all other conditions of the approved PUD RZ 90-15 remain effective; and the Board approved rezoning for first reading on June 10, 2003,

NOW THEREFORE BE IT RESOLVED That the Pittsfield Township Board of Trustees approves the second reading of the request to add libraries to the approved use list for the Park Place for Business PUD District be and that all other conditions of the approved PUD RZ 90-15 remain effective.

12.5 Request Approval of Resolution Authorizing Appointment of A Deputy Enforcement Officer and Revocation Of An Appointment Of A Deputy Enforcement Officer Of The Municipal Services Department. This resolution removes Kristine Goddard and adds Jennifer Black as Deputy Ordinance Officer.

Motion by Clerk Lirones, supported by Trustee Burhop, to approve the resolution authorizing the appointment of a Deputy Enforcement Officer and the revocation of an appointment of a Deputy Enforcement Officer of the Municipal Services Department. This resolution removes Kristine Goddard and adds Jennifer Black as Deputy Ordinance Officer. (See attachment #2).

Clerk Lirones noted that the Board had not received Kristine Goddard’s resignation letter. She said as a matter of record it should be received at the next Board meeting.

Senior Planner Spencer said passing this resolution does not mean Ms. Black will be doing any enforcing right away, but it was important to have her in place as a deputy in case he was not available. He said as she becomes more experienced with violations and enforcement, she will be gradually put into that position.

15.1 Appointment of a Board of Trustee Member to the Historical Commission and the Housing Commission to fill vacancy left by Commissioner Jeffrey Marine.

Motion by Treasurer Skrobola, supported by Trustee Burhop, to appoint Trustee Brostrom to the Historical Commission and Trustee Conner to the Housing Commission to fill the vacancy left by Commissioner Jeffrey Marine’s resignation.

MOTION CARRIED.

Supervisor Walter said he received a request from the Historical Commission to review the appointment of Ms. Anita Wilson, who is on the Commission, but has not attended any meetings in over a year. He said after several attempts to contact Ms. Wilson to find out what her further interests were, he had received an indication that she was not interested in continuing, but she did not care to resign. He said he had passed out a memo to the Board removing Ms. Wilson, which the Supervisor has authority to do under the ordinance. He said he has considered one person so far to replace Ms. Wilson, and added that if any Board members knew of others who might be interested, he would be willing to consider them. He said he would like to make the appointment at the next Board meeting.

15.2Resolution to Approve The Pilot Wetlands Television Educational Project.

Motion by Treasurer Skrobola, supported by Trustee Brostrom, to approve the Pilot Wetlands Television Educational Project.

WHEREAS, the Pittsfield Charter Township Natural Resources Commission wishes to educate the general public on the value of wetlands and inform the public on its responsibility for stewardship of wetlands, and conservation of natural resources, using video media from EPA, Sierra Club and other sources, and

WHEREAS, these video episodes are proposed to air on CTN, the public access Ann Arbor Community Television Network, and

WHEREAS, the Pittsfield Natural Resources Commission voted on June 12, 2003, to recommend that the Board approve an expenditure for this purpose, using funds budgeted for Phase II Compliance, which includes public education,

NOW THEREFORE BE IT RESOLVED that the Pittsfield Board of Trustees authorizes an expenditure, not to exceed $500, to cover charges for the media (tape), and any technical requirements to air during the fourth quarter of this year on Community Access Television.

Trustee Conner said this project would be part of the educational effort being made by the Natural Resources Commission, specifically regarding wetlands. He said included with the resolution are some background materials on the type of videos that are available, which the Commission is proposing to air on CTN. He said in order to get the videos, copy them, get them in the right format, and then return them, the Natural Resources Commission is proposing the expenditure of $500 in the last quarter of this year.

Supervisor Walter said he was not sure if Pittsfield Township has automatic access to the cable network.

Trustee Conner said the Commissioners have done some research and have found that a non-profit organization located in Ann Arbor would qualify to use the network. Since the township belongs to the Huron River Watershed Council, this would allow the township to air these programs on CTN, through the HRWC.

Supervisor Walter asked if there were any copyright issues that needed to be addressed.

Conner said he contacted the EPA and their videos are made for these purposes, so it would be free and clear of copyright restrictions.

Trustee Brostrom asked about the Sierra Club and the other sources.

Trustee Conner said the Commission has not checked all the sources, but feels there is ample material just from the EPA to establish a series.

Trustee Marine asked what the $500.00 would be used for.

Trustee Conner said postage will be needed to have the packages mailed to the Commission, and then return them. He said there will be fees associated with duplicating the videos if the Commission uses a commercial reproduction service. He said this request is not to exceed the $500, adding that if the Commissioners can use the facilities of CTN to duplicate the videos, they will.

Trustee Brostrom asked how this was going to be publicized to target Pittsfield residents?

Trustee Conner said the Huron River Watershed Council can help publicize the series through print and media.

Supervisor Walter said someone from the Pittsfield Natural Resources Commission could write a small article which could go in the community bulletin.

Trustee Conner said there is also a bulletin on CTN itself where this can be publicized.

Trustee Marine asked what format the videos come in, what format is needed, and what was involved in the duplication process.

Trustee Conner said sometimes they come in a super VHS, which can be duplicated at CTN. He said they may come on a beta cassette, which would require a format change.

Trustee Marine said the process can get expensive compared to duplicating a normal home video cassette tape.

Trustee Conner agreed.

Trustee Marine said he was concerned about the cost of duplication. He then asked if this could be done in private homes.

Trustee Conner said probably not, and if they are reproduced professionally, the quality will be good. He added that people could call CTN to request the airing of these programs.

Treasurer Skrobola said he wished to give some information to the Board regarding tax bills. He said the state education tax, which was six mills last year, is reviewed by the state on an annual basis, and this year it was determined that two things will change. He said one change would be a reduction from six to five mills. The second change is that in previous years, the six mills were split, with three mills on the summer tax bill and three mills on the winter tax bill; however, this summer, the entire five mills will be billed in the summer. He said this will lead to a larger property tax bill in the summer, but the good part is that hopefully the tax bill in the winter will be a little less.

Trustee Marine asked Treasurer Skrobola if he knew what effect this will have on school funding.

Treasurer Skrobola said he did not know, adding this was not a determination made at the local level, but at the state level.

Supervisor Walter said he believed this was put forward by the Engler Administration, and this shifted tax collection forward by six months, which in essence will lead to collecting more. He added that he believed the intention was to return to the six mill level after this first year of doing the collection in this manner, and that the five mill level had been set to ease the transition to this new collection schedule.

Treasurer Skrobola noted that the state makes a decision annually on the number of mills to be levied.

Supervisor Walter agreed, but said he believed the intention was to go back to the six mill level after this time shift, which had the effect of helping out the schools in terms of their current cash flow.

Minutes of a Regular Meeting of the Township Board of Pittsfield Charter Township, Washtenaw County, Michigan held at the Township Administration Building located at 6201 W. Michigan Avenue in said Township, on the 24th day of June, 2003 at 7:30 p.m.

The following preamble and resolution were offered by Member Skrobola and supported by Member Lirones.

Whereas, the Township receives applications and requests for tax abatement districts, known as Industrial Facilities Exemptions, and

Whereas, the Township Clerk must work with the Township Assessing Department, Treasurer, and attorney to create the district and process the application, and

Whereas, the processing of the application also includes legal publications, advertising, and certified mailings, and

Whereas, the Township is allowed to recoup the costs associated with the creation of the IFE district and processing of the application,

Now, therefore be it resolved, that Pittsfield Charter Township sets an administrative fee of $1000.00 for setting up an Industrial Facilities Exemption District and processing the application.

The following preamble and resolution were offered by Member Lirones and supported by Member Burhop.

WHEREAS, the Township Board has adopted the Municipal Services Department Ordinance of Pittsfield Charter Township, being Ordinance No. 236, as amended; and

WHEREAS, said Ordinance provides for the appointment of a Director and Deputies of the Municipal Services Department; and

WHEREAS, the Township Board has adopted the Ordinance Enforcement Officer Ordinance of Pittsfield Charter Township, being Ordinance No. 220, as amended;

NOW, THEREFORE, BE IT RESOLVED THAT,

1. The person designated below in paragraph 2, is appointed Deputy Ordinance Enforcement Officer pursuant to Section 3 of Ordinance No. 220, and is authorized to enforce the ordinances of Pittsfield Township as specified in the following paragraph.

2. The Township Board, in accordance with the terms and provisions of the Municipal Services Department Ordinance of Pittsfield Charter Township, hereby appoints JENNIFER BLACK, as a Deputy of the Pittsfield Charter Township Municipal Services Department and authorizes her to enforce, and issue and serve appearance tickets and municipal civil infraction citations and notices of violations of, the Zoning Ordinance of Pittsfield Township, being Ordinance No. 38 as may be amended, the Blight Ordinance, being Ordinance No. 36, as may be amended, the Landfill Ordinance, being Ordinance No. 10, as may be amended, the Pittsfield Township Subdivision Ordinance No. 255, as may be amended, the Pittsfield Charter Township Soil Erosion and Sedimentation Ordinance, being Ordinance No. 256, as may be amended, the Burning Ordinance of Pittsfield Township, being Ordinance No. 205, as may be amended, the Property Identification Ordinance of Pittsfield Township, being Ordinance No. 197, as may be amended, the Sidewalk Maintenance Ordinance being Ordinance No. 218, as may be amended, the Weed Control Ordinance, being Ordinance No. 251, as may be amended and the Wetland Protection Ordinance, being Ordinance No. 255 as may be amended.

3. The previous authorization of KRISTINE GODDARD to enforce, issue and serve appearance tickets and municipal civil infraction citations and notices for violations of any Township ordinance is hereby revoked.

WHEREAS, the Pittsfield Charter Township planning staff has reviewed the costs associated with planning, zoning and wetland permit services, and

WHEREAS, the Township’s current fees omitted items and needed further clarification to adequately cover the cost of these services; and

WHEREAS, the Township Board believes that the taxpayers of Pittsfield Charter Township should not subsidize development costs.

NOW THEREFORE BE IT RESOLVED, that the Pittsfield Charter Township Board of Trustees hereby approves the revised Planning, Zoning and Wetland Permit Fee Schedule, as submitted. These fees shall become effective immediately.
